2. Acceptance of These Terms

You have not previously been permanently removed from the Service unless we have expressly authorized your return.

Verification does not constitute an endorsement of a user, guarantee authenticity, or guarantee future conduct.

We reserve the right to revoke verification at any time.

You are solely responsible for ensuring that your profile content complies with these Terms and applicable law.

10. Accuracy of Information

You agree not to knowingly provide false or misleading information, including but not limited to:

Identity
Age
Photographs
Location
Relationship status
Credentials
Experience
Organizational affiliations

Nox does not independently verify all information submitted by users and makes no guarantees regarding the accuracy of user-generated content.

Users are responsible for exercising their own judgment when interacting with others.

11. Privacy and Visibility

Nox is designed with privacy in mind.

Depending on your account type and available features, you may be able to control aspects of your visibility, including:

Whether your profile appears in discovery.
Whether your online status is visible.
Which users may contact you.
Whether your location is displayed.
Whether your profile is visible only to users with whom you have interacted.

Availability of privacy controls may vary by subscription tier and may change over time.

No privacy setting can guarantee complete anonymity or prevent all unauthorized access.

Users remain responsible for exercising appropriate discretion when sharing personal information.

12. User Content

"User Content" includes anything you submit through the Service, including:

Text
Messages
Images
Audio
Video
Artwork
Ritual descriptions
Educational materials
Comments
Reactions
Circle posts
Profile information
Metadata
Any other information submitted through the Service.

You retain ownership of your User Content.

However, by submitting User Content, you grant Nox Community Inc. a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, adapt, modify (solely for technical purposes such as formatting, compression, resizing, accessibility, security, translation, or compatibility), distribute, display, perform, and otherwise use your User Content as reasonably necessary to operate, improve, promote, secure, and provide the Service.

This license includes the right to:

Generate thumbnails.
Optimize images.
Cache content.
Create backups.
Moderate content using human reviewers or automated systems.
Display content to users according to your privacy settings.
Use limited excerpts of public content in promotional materials, educational materials, or demonstrations of the Service, unless you have deleted the content before such use or applicable law requires otherwise.

This license ends when your content is permanently deleted from our systems, except to the extent that:

copies remain in routine backups,
retention is required by law,
the content has been shared by other users in accordance with platform functionality,
or continued retention is reasonably necessary for fraud prevention, legal compliance, enforcement of these Terms, dispute resolution, or protection of the Service.

You represent and warrant that you own, or have all necessary rights to submit, your User Content and to grant the foregoing license.

You further represent that your User Content does not violate the rights of any person or entity.

13. Content Standards

You agree that any content you upload will be lawful, respectful of others' rights, and appropriate for the intended use of the Service.

Content must not:

Infringe intellectual property rights.
Violate privacy rights.
Promote violence against individuals or groups.
Contain unlawful threats.
Encourage criminal activity.

Nox may establish additional Community Guidelines that supplement these Terms. Those guidelines become part of these Terms by reference.

Violation of the Community Guidelines may result in warnings, content removal, feature restrictions, temporary suspension, permanent account termination, or referral to law enforcement where appropriate.

14. Community Standards

Nox exists to foster thoughtful, respectful, and privacy-conscious interactions among individuals exploring esoteric, occult, philosophical, and related interests.

We recognize that many discussions on the Service involve sincerely held beliefs, spiritual practices, religious traditions, philosophical viewpoints, and personal experiences. Nox does not endorse, verify, or validate any particular belief system, tradition, organization, teacher, or claim made by users.

Users are expected to engage with one another in good faith.

Healthy disagreement is permitted. Harassment is not.

15. Prohibited Conduct

You agree that you will not use the Service to:

Harass, stalk, intimidate, threaten, or abuse another user.
Encourage self-harm, violence, or unlawful conduct.
Impersonate another individual or organization.
Create misleading or deceptive profiles.
Engage in catfishing or identity fraud.
Circumvent bans or moderation actions.
Create multiple accounts to avoid platform restrictions.
Buy, sell, or transfer user accounts.
Scrape, crawl, harvest, or systematically collect user information.
Reverse engineer or interfere with the Service.
Introduce malware or malicious code.
Attempt unauthorized access to our systems.
Conduct phishing or social engineering attacks.
Use bots or automated systems except where expressly authorized.
Send spam, unsolicited advertisements, chain messages, or mass solicitations.
Promote pyramid schemes or fraudulent investment opportunities.

Joining private communities.

Any offline meeting or transaction occurs entirely at your own risk.

18. Messages and Communications

The Service may include messaging, conversation requests, comments, reactions, and other communication features.

Illegal activity

Nox may impose limits on messaging volume, conversation requests, attachments, storage capacity, or other communication features.

We reserve the right to remove communications that violate these Terms.

19. Circles and Community Spaces

Nox may provide user-created communities, groups, Circles, forums, or similar spaces.

Circle owners and moderators may establish additional rules for participation.

These rules may not conflict with these Terms.

Nox reserves the right to:

Remove Circle content.
Remove moderators.
Transfer moderation privileges.
Close inactive Circles.
Remove communities that violate these Terms.
Intervene where necessary to protect users or the platform.

20. Recommendation Systems

Nox may use automated systems to recommend users, content, communities, conversations, or other features.

Recommendations may consider factors such as:

Shared interests
Profile information
Community participation
Preferences
Geographic region
User activity
Privacy settings
Safety signals
Subscription features
Other relevance indicators

The exact operation of our recommendation systems is proprietary.

We do not guarantee that recommendations will be accurate, complete, unbiased, or suitable for any particular purpose.

We reserve the right to modify recommendation algorithms at any time without notice.

Users may not attempt to manipulate or reverse engineer recommendation systems.

21. Embers and Virtual Items

The Service may include virtual items, including but not limited to Embers, offerings, badges, gifts, reactions, cosmetics, profile enhancements, and future digital features.

These virtual items are licensed, not sold.

They have no cash value.

They are not redeemable for money.

They are not transferable unless expressly permitted by Nox.

They may not be traded outside the Service.

You acquire only a limited, revocable license to use virtual items within the Service.

Nox may modify, replace, rebalance, discontinue, or remove virtual items at any time.

Unused virtual items may expire where permitted by law.

Virtual items are not personal property.

22. Embers

Embers are intended to encourage thoughtful interactions by limiting unsolicited outreach and promoting meaningful engagement.

Nox may determine, in its sole discretion:

Daily Ember allowances.
Premium Ember benefits.
Earning methods.
Recharge schedules.
Maximum balances.
Expiration rules.
Usage requirements.
Availability in different regions.

Attempting to generate Embers through automation, exploitation, fraud, or abuse is prohibited.

Nox may revoke improperly obtained Embers without compensation.

23. Premium Memberships

Nox may offer optional paid memberships, including Nocturne and other subscription tiers.

Membership benefits may include, without limitation:

Increased platform features.
Expanded messaging capabilities.
Enhanced privacy controls.
Additional customization.
Higher discovery visibility.
Access to exclusive features.
Priority access to new functionality.

Membership benefits are subject to change.

No specific feature is guaranteed to remain available indefinitely.

24. Billing and Automatic Renewal

Unless otherwise stated, subscriptions automatically renew at the end of each billing period.

By purchasing a subscription, you authorize us or our payment processor to charge your selected payment method for recurring subscription fees until cancelled.

It is your responsibility to cancel your subscription before the renewal date if you do not wish to continue.

Cancellation prevents future renewals but does not automatically generate refunds for the current billing period except where required by law.

Nox is not responsible for failures, interruptions, delays, or errors caused by payment providers.

Have no cash value unless expressly stated.

Nox makes no promise that any proposed feature, roadmap item, or announcement will ultimately be released.

Subject to your compliance with these Terms, Nox grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service solely for its intended purposes.

No other rights are granted.

34. Restrictions on Use

You may not, except as expressly permitted by applicable law:

Modify the Service.
Create derivative works.
Reverse engineer the Service.
Decompile software.
Disassemble software.
Circumvent technological protections.

Virtual items, subscriptions, usernames, profile visibility, and other account privileges may be forfeited upon termination, except where prohibited by law.

40. User-Initiated Account Deletion

You may delete your account using the tools provided within the Service, where available.

Deletion requests may require verification of account ownership.

Certain information may be retained after deletion:

Where required by law.
To resolve disputes.
To prevent fraud.
To enforce these Terms.
For backup and disaster recovery purposes.

Deletion of an account does not automatically remove content previously shared with other users where continued retention is technically necessary or legally permitted.

47. Indemnification

You agree to defend, indemnify, and hold harmless Nox Community Inc., its officers, directors, employees, contractors, volunteers, moderators, affiliates, licensors, successors, assigns, and service providers from and against any claims, liabilities, damages, judgments, settlements, penalties, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use of the Service.
Your User Content.
Your violation of these Terms.
Your violation of applicable law.
Your infringement of another person's rights.
Your interactions with other users.

This obligation survives termination of your account.

48. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.

49. Binding Arbitration

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through final and binding arbitration rather than in court, except that either party may seek relief in small claims court where jurisdiction permits.

Arbitration shall be conducted on an individual basis.

You waive any right to participate in a class action, class arbitration, consolidated proceeding, or representative action against Nox Community Inc., except where such waivers are prohibited by applicable law.

Nothing in this section limits either party's right to seek temporary or preliminary injunctive relief to protect intellectual property rights, confidential information, or platform security.

You agree not to use the Service in violation of applicable export control laws, sanctions regulations, or trade restrictions of the United States or any other applicable jurisdiction.

51. Assignment

You may not assign or transfer these Terms or your account without our prior written consent.

Nox may assign these Terms, in whole or in part, in connection with a merger, acquisition, corporate restructuring, financing, or sale of assets without restriction.

52. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
